Greenspoon Marder is a Fort Lauderdale, Florida-based "full-service business law firm"[1] with offices in Aventura, Boca Raton, Miami, Naples, Orlando, Port St. Lucie, West Palm Beach and Tampa.[2] Sometime prior to February 2012, the firm was hired by the telemarketing scam company, Caribbean Cruise Line (also based in Florida), to take legal action against members of the Prank Calling Community that had been harassing them.

Threats to Wilford Brimley and others

In April 2013, the YouTube uploader and prank caller, Wilford Brimley, received the following Cease & Desist letter via private message purporting to be from the firm:[3]

Dear YouTube user, "Wilford Brimley":

It has come to our attention that you have been making inflammatory, "prank" calls to our client, Caribbean Cruise Line, Inc., and that you have posted recordings of the calls on this YouTube channel. Please be advised that these actions not only constitute tortous harassment, but are also illegal pursuant to various United States and Florida Laws, including Florida Statutes, Section 934.03. If these actions continue, we will be forced to take legal action against you.

As a result, he was forced to remove all prank calls that involved Caribbean Cruise Line or soundboards of its employees, such as CCL Larry from his channel. Apparently, this compliance was still not enough to satisfy them and on July 23, 2013, his main channel was closed down by YouTube, allegedly following further complaints / threats from Caribbean Cruise Line and Greenspoon Marder. He has since stated that several other YouTube prank callers, such as Herbert Stevensh, have received identical C&D letters purporting to be from the firm and have had their accounts terminated thereafter as well.

Undeterred, Wilford Brimley later reuploaded his collection of CCL prank calls to his alternate channel. In July 2013, YouTube prankster Zamot83 began prank calling Greenspoon Marder's offices, as a measure of retaliation. They had previously been called in May by Prank Hill.

Lawsuit against ImmaArnie

On February 21, 2012, the YouTube uploader and prank caller, ImmaArnie, who had been harassing Caribbean Cruise Line for over a year, was sent the following strongly-worded Cease & Desist letter from Greenspoon Marder via private messaging on YouTube, giving him just 24 hours to take everything down and never prank call CCL again, or else:

This firm represents Caribbean Cruise Line, Inc. ('CCL'). Be advised that you have violated Florida statute 934.03, which makes it a third degree felony to record or intercept any wire, oral, or electronic communication. CCL is a Florida corporation and its counsel has notified Youtube, LLC of your violation.

Demand is hereby made that you immediately remove each video you have posted on Youtube in which you record a conversation with CCL or its employees. If you fail to remove the videos by February 22 and fail to cease and desist from recording phone conversations with CCL, CCL will file a lawsuit against you and seek all other remedies available under applicable law.

ImmaArnie's response to the message: "Sue me, dickhead." This prompted the firm to issue a follow-up threat the next day:

As you were previously advised, this firm represents Caribbean Cruise Line, Inc. ('CCL'). As you have failed to comply with the Cease and Desist provided on February 21, 2012, we are in the process of notifying the authorities that you have violated Florida Statute 934.03 Also, you will be responsible for a fine [of] up to $5,000 for violation of Florida Statute 934.03.

In addition to the threats he received via private message on YouTube, ImmaArnie says that both Greenspoon Marder and Caribbean Cruise Line harassed him through his Facebook and Twitter accounts as well. When all of this this, again, failed to scare him into compliance, the firm made good on its threats. In June of that year, Greenspoon Marder attorney, Eric Feld, acting on behalf of Caribbean Cruise Line, filed an "application for discovery subpoena in action pending outside California" with the California Superior Court in San Jose, California in order to force Google, Inc. (the owners of YouTube) to release ImmaArnie's personal info and the contents of his gmail accounts to them, which was granted.[4]

Fortunately, ImmaArnie was one step ahead of them and the only information they received was utterly useless to them:

IP address: Proxy in Japan
Hobbies: Prank calling
Religion: Prank calling
Sexual preferences: Calling from Springfield."

Google later appealed the decision and won, after which Greenspoon Marder apparently realized the futility of the situation and let the matter drop. Much like Wilford Brimley, ImmaArnie's account was closed down by YouTube, but he later repuploaded his calls to Caribbean Cruise Line to an alternate account and has since resumed harassing the company under a new alias.

Impersonated by Caribbean Cruise Line?

There is some speculation among members of the Prank Calling Community that Greenspoon Marder may not actually be the ones sending the latest round of C&D letters, such as the one received by Wilford Brimley. The theory, which originated with Youtube uploader and prankster Billybob James, is that Caribbean Cruise Line, is in fact, impersonating the aforementioned lawyers in order to scare the pranksters into leaving them alone.

However, it should be noted that the impersonation theory has not been definitively proven and most pranksters have chosen to err on the side of caution and take the threat seriously. Given what happened to ImmaArnie in 2012, this is probably wise. So far, though, the situation has not lead to a mass exodus of prank callers, as with the 2008 and 2011 Duncan Scares or the Nightmare on Burton Street incident.
